Nintendo & Pokemon Vs. Palworld (My Thoughts)

I'll admit, this wasn't gonna be my "big comeback" blog post, but here we are...

Hey guys, this is Brian from Gamepoint+ and today I just wanted to get my thoughts out about, well this.


I agree that Nintendo suing PocketPair/Palword for patent infringement is a slippery slope, game mechanics and ideas can be very similar throughout games. Even under different game genres. Plus, as many others have stated, other games have done things similar to Pokemon and Nintendo has done things similar to other games before them. In that regard, it's not the fairest idea. However, Palworld didn't exactly paint themselves in the best light though. They've openly admitted to using AI-Art to create those creatures, which is already a red-flag. Everyone, even big game reviewers/journalists, called them "Pokemon with guns" and they just kinda steered into that skid, and A lot of this game's popularity came from everyone comparing it Pokemon. Unlike games like Ni-No Kuni, Yo-Kai Watch, Persona, or Digimon, who advertised their unique gameplay, story, character designs, etc. Palword advertises itself, admittedly inadvertently, by comparing itself to Pokemon, and not even in legitimate/fair comparisons, mainly negative/passive aggressive, "We do this like Pokemon, but we kill our creatures, Something Nintendo & Pokemon will never do. Hahahaha."


If this lawsuit was against a game like "The Plucky Squire" (which is an awesome game btw) which is a game that has a lot of comparisons to Zelda, Punch-Out, etc. Then Nintendo & Pokemon Co would absolutely be in the wrong. But it isn't, and they aren't going to do that, because that game has its own identity, original idea, and balances using new ideas with older ideas. Palworld, IMO, isn't doing that. It has some cool ideas, but it's just taking what we know about Pokemon and just putting guns and "cute" death animations in. While I understand how The Big N & Pokemon suing Palworld for Patent infringement is problematic, it's probably their stongest defense against them, considering Copyright is a bit "looser" from my understanding. And while yes, they're on a slippery slope with this lawsuit, I just think its only fair to ask, how did we get on this slope to begin with, and why is it so slippery?
